Colorado SR-22 Filing Requirement After DUI

Colorado requires SR-22 filing after every DUI, DUI per se, and DWAI conviction. The filing period is 3 years, measured from the date your license is reinstated — not the conviction date. If you delay reinstatement by 6 months, your 3-year SR-22 clock starts 6 months later.

The carrier files SR-22 electronically with the Colorado Division of Motor Vehicles within 24 hours of binding coverage. There is no separate state filing fee; the carrier charges a small one-time processing fee at policy inception. If your policy lapses or cancels during the 3-year period, the carrier notifies the DMV immediately and your license is re-suspended until you file new SR-22 with a replacement carrier.

Probationary License During Suspension

Colorado offers a Probationary Driver License (Red License) that allows limited driving during your 270-day DUI suspension. The license restricts you to driving to and from your place of employment or while performing employment duties. You cannot drive for personal errands, childcare, or medical appointments unless those trips occur during work hours as part of your job.

You request the Probationary License through a Department of Revenue hearing. The hearing officer evaluates your employment need and issues the restricted license if you meet eligibility requirements. You must surrender your regular license, provide proof of employment, and maintain SR-22 insurance coverage throughout the probationary period.

The Probationary License does not shorten your 270-day suspension. It allows you to drive for work purposes only while the suspension runs. If you violate the route restrictions or drive for unapproved purposes, the probationary license is revoked and you serve the remainder of the suspension with no driving privileges.
